Terms and Conditions for Selling Digital Art and Print-on-Demand Products
Introduction
These Terms and Conditions govern the sale of digital art and print-on-demand products by [riyad kishi/ شخوطة] (hereinafter referred to as "Seller") to the purchaser (hereinafter referred to as "Buyer").
Ownership and Copyright
 * Digital Art: Upon purchase, the Buyer acquires a non-exclusive license to use the digital art for personal use only. The Seller retains all copyright and intellectual property rights to the artwork.
 * Print-on-Demand Products: The Buyer acquires ownership of the physical print-on-demand product upon purchase. However, the Seller retains the copyright and intellectual property rights to the artwork used on the product.
Delivery and Access
 * Digital Art: Digital art is delivered electronically upon completion of the purchase. The Buyer will receive a download link or access to a digital platform to obtain the purchased artwork.
 * Print-on-Demand Products: Print-on-demand products are produced and shipped to the Buyer upon order placement. Shipping times may vary depending on the product and the Buyer's location.
Refunds and Returns
 * Digital Art: Due to the digital nature of the product, refunds are generally not provided unless otherwise agreed upon in writing. Exceptions may be made in cases of significant errors or defects in the artwork, at the Seller's discretion.
 * Print-on-Demand Products: The Buyer may return defective or damaged print-on-demand products for a replacement or refund within 3 days of receipt. The Buyer is responsible for return shipping costs.
Disclaimer of Warranty
 * Digital Art: The digital art is provided "as is" without any warranties, express or implied, including but not limited to warranties of merchantability or fitness for a particular purpose.
 * Print-on-Demand Products: While the Seller takes reasonable care in the production of print-on-demand products, there may be slight variations in color and quality due to printing processes. The Seller does not warrant that print-on-demand products will be free from defects.
Limitation of Liability
 * The Seller shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or in connection with the purchase or use of digital art or print-on-demand products.
 * The Seller's total liability to the Buyer for any claim shall not exceed the purchase price of the digital art or print-on-demand product.
Governing Law
 * These Terms and Conditions shall be governed by and construed in accordance with the laws of [Jurisdiction].
Entire Agreement
 * These Terms and Conditions constitute the entire agreement between the Seller and the Buyer and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.
